Article 1
The International Court of Justice established by the Charter of the United Nations as the principal judicial organ of the United Nations shall be constituted and shall function in accordance with the provisions of the present Statute.
    第一條  
    聯(lián)合國(guó)憲章所設(shè)之國(guó)際法院為聯(lián)合國(guó)主要司法機(jī)關(guān),其組織及職務(wù)之行使應(yīng)依本規(guī)約之下列規(guī)定。
Chapter I: Organization of the Court
第一章  法院之組織
Article 2
The Court shall be composed of a body of independent judges, elected regardless of their nationality from among persons of high moral character, who possess the qualifications required in their respective countries for appointment to the highest judicial offices, or are jurisconsults of recognized competence in international law.

    法院以獨(dú)立法官若干人組織之。此項(xiàng)法官應(yīng)不論國(guó)籍,就品格高尚并在各本國(guó)具有最高司法職位之任命資格或公認(rèn)為國(guó)際法之法學(xué)家中選舉之。
Article 3
1. The Court shall consist of fifteen members, no two of whom may be nationals of the same state.
2. A person who for the purposes of membership in the Court could be regarded as a national of more than one state shall be deemed to be a national of the one in which he ordinarily exercises civil and political rights.
    第三條  
    一、法院以法官15人組織之,其中不得有二人為同一國(guó)家之國(guó)民。
    二、就充任法院法官而言,一人而可視為一個(gè)國(guó)家以上之國(guó)民者,應(yīng)認(rèn)為屬于其通常行使公民及政治權(quán)利之國(guó)家或會(huì)員國(guó)之國(guó)民。
Article 4
1. The members of the Court shall be elected by the General Assembly and by the Security Council from a list of persons nominated by the national groups in the Permanent Court of Arbitration, in accordance with the following provisions.
2. In the case of Members of the United Nations not represented in the Permanent Court of Arbitration, candidates shall be nominated by national groups appointed for this purpose by their governments under the same conditions as those prescribed for members of the Permanent Court of Arbitration by Article 44 of the Convention of The Hague of 1907 for the pacific settlement of international disputes.
3. The conditions under which a state which is a party to the present Statute but is not a Member of the United Nations may participate in electing the members of the Court shall, in the absence of a special agreement, be laid down by the General Assembly upon recommendation of the Security Council.

    一、法院法官應(yīng)由大會(huì)及安全理事會(huì)依下列規(guī)定就常設(shè)公斷法院各國(guó)團(tuán)體所提出之名單內(nèi)選舉之。
    二、在常設(shè)公斷法院并無(wú)代表之聯(lián)合國(guó)會(huì)員國(guó),其候選人名單應(yīng)由各該國(guó)政府專為此事而委派之團(tuán)體提出;此項(xiàng)各國(guó)團(tuán)體之委派,準(zhǔn)用1907年海牙和平解決國(guó)際紛爭(zhēng)條約第四十四條規(guī)定委派常設(shè)公斷法院公斷員之條件。
    三、凡非聯(lián)合國(guó)會(huì)員國(guó)而已接受法院規(guī)約之國(guó)家,其參加選舉法院法官時(shí),參加條件,如無(wú)特別協(xié)定,應(yīng)由大會(huì)經(jīng)安全理事會(huì)之提議規(guī)定之。
Article 5
1. At least three months before the date of the election, the Secretary-General of the United Nations shall address a written request to the members of the Permanent Court of Arbitration belonging to the states which are parties to the present Statute, and to the members of the national groups appointed under Article 4, paragraph 2, inviting them to undertake, within a given time, by national groups, the nomination of persons in a position to accept the duties of a member of the Court.
2. No group may nominate more than four persons, not more than two of whom shall be of their own nationality. In no case may the number of candidates nominated by a group be more than double the number of seats to be filled.

    一、聯(lián)合國(guó)秘書長(zhǎng)至遲應(yīng)于選舉日期三個(gè)月前,用書面邀請(qǐng)屬于本規(guī)約當(dāng)事國(guó)之常設(shè)公斷法院公斷員,及依第四條第二項(xiàng)所委派之各國(guó)團(tuán)體,于一定期間內(nèi)分別由各國(guó)團(tuán)體提出能接受法官職務(wù)之人員。
    二、每一團(tuán)體所提人數(shù)不得超過四人,其中屬其本國(guó)國(guó)籍者不得超過二人。在任何情形下,每一團(tuán)體所提候選人之人數(shù)不得超過應(yīng)占席數(shù)之一倍。
Article 6
Before making these nominations, each national group is recommended to consult its highest court of justice, its legal faculties and schools of law, and its national academies and national sections of international academies devoted to the study of law.
    第六條  
    各國(guó)團(tuán)體在提出上項(xiàng)人員以前,宜咨詢本國(guó)最高法院、大學(xué)法學(xué)院、法律學(xué)校、專研法律之國(guó)家研究院、及國(guó)際研究院在各國(guó)所設(shè)之各分院。
Article 7
1. The Secretary-General shall prepare a list in alphabetical order of all the persons thus nominated. Save as provided in Article 12, paragraph 2, these shall be the only persons eligible.
2. The Secretary-General shall submit this list to the General Assembly and to the Security Council.
    第七條  
    一、秘書長(zhǎng)應(yīng)依字母次序,編就上項(xiàng)所提人員之名單。除第十二條第二項(xiàng)規(guī)定外,僅此項(xiàng)人員有被選權(quán)。
    二、秘書長(zhǎng)應(yīng)將前項(xiàng)名單提交大會(huì)及安全理事會(huì)。
Article 8
The General Assembly and the Security Council shall proceed independently of one another to elect the members of the Court.
    第八條  
    大會(huì)及安全理事會(huì)各應(yīng)獨(dú)立舉行法院法官之選舉。
Article 9
At every election, the electors shall bear in mind not only that the persons to be elected should individually possess the qualifications required, but also that in the body as a whole the representation of the main forms of civilization and of the principal legal systems of the world should be assured.
    第九條  
    每次選舉時(shí),選舉人不獨(dú)應(yīng)注意被選人必須各具必要資格,并應(yīng)注意務(wù)使法官全體確能代表世界各大文化及各主要法系。
Article 10
1. Those candidates who obtain an absolute majority of votes in the General Assembly and in the Security Council shall be considered as elected.
2. Any vote of the Security Council, whether for the election of judges or for the appointment of members of the conference envisaged in Article 12, shall be taken without any distinction between permanent and non-permanent members of the Security Council.
3. In the event of more than one national of the same state obtaining an absolute majority of the votes both of the General Assembly and of the Security Council, the eldest of these only shall be considered as elected.

    一、候選人在大會(huì)及在安全理事會(huì)得絕對(duì)多數(shù)票者應(yīng)認(rèn)為當(dāng)選。
    二、安全理事會(huì)之投票,或?yàn)榉ü僦x舉或?yàn)榈谑䲢l所稱聯(lián)席會(huì)議人員之指派,應(yīng)不論安全理事會(huì)常任理事國(guó)及非常任理事國(guó)之區(qū)別。
    三、如同一國(guó)家之國(guó)民得大會(huì)及安全理事會(huì)之絕對(duì)多數(shù)票者不止一人時(shí),其年事最高者應(yīng)認(rèn)為當(dāng)選。
Article 11
If, after the first meeting held for the purpose of the election, one or more seats remain to be filled, a second and, if necessary, a third meeting shall take place.
    第十一條  
    第一次選舉會(huì)后,如有一席或一席以上尚待補(bǔ)選時(shí),應(yīng)舉行第二次選舉會(huì),并于必要時(shí)舉行第三次選舉會(huì)。
Article 12
1. If, after the third meeting, one or more seats still remain unfilled, a joint conference consisting of six members, three appointed by the General Assembly and three by the Security Council, may be formed at any time at the request of either the General Assembly or the Security Council, for the purpose of choosing by the vote of an absolute majority one name for each seat still vacant, to submit to the General Assembly and the Security Council for their respective acceptance.
2. If the joint conference is unanimously agreed upon any person who fulfills the required conditions, he may be included in its list, even though he was not included in the list of nominations referred to in Article 7.
3. If the joint conference is satisfied that it will not be successful in procuring an election, those members of the Court who have already been elected shall, within a period to be fixed by the Security Council, proceed to fill the vacant seats by selection from among those candidates who have obtained votes either in the General Assembly or in the Security Council.
4. In the event of an equality of votes among the judges, the eldest judge shall have a casting vote.

    一、第三次選舉會(huì)后,如仍有一席或一席以上尚待補(bǔ)選時(shí),大會(huì)或安全理事會(huì)得隨時(shí)聲請(qǐng)組織聯(lián)席會(huì)議,其人數(shù)為六人,由大會(huì)及安全理事會(huì)各派三人。此項(xiàng)聯(lián)席會(huì)議就每一懸缺以絕對(duì)多數(shù)票選定一人提交大會(huì)及安全理事會(huì)分別請(qǐng)其接受。
    二、具有必要資格人員,即未列入第七條所指之候選人名單,如經(jīng)聯(lián)席會(huì)議全體同意,亦得列入該會(huì)議名單。
    三、如聯(lián)席會(huì)議確認(rèn)選舉不能有結(jié)果時(shí),應(yīng)由已選出之法官,在安全理事會(huì)所定之期間內(nèi),就曾在大會(huì)或安全理事會(huì)得有選舉票之候選人中,選定若干人補(bǔ)足缺額。
    四、法官投票數(shù)相等時(shí),年事最高之法官應(yīng)投決定票。
Article 13
1. The members of the Court shall be elected for nine years and may be re-elected; provided, however, that of the judges elected at the first election, the terms of five judges shall expire at the end of three years and the terms of five more judges shall expire at the end of six years.
2. The judges whose terms are to expire at the end of the above-mentioned initial periods of three and six years shall be chosen by lot to be drawn by the Secretary-General immediately after the first election has been completed.
3. The members of the Court shall continue to discharge their duties until their places have been filled. Though replaced, they shall finish any cases which they may have begun.
4. In the case of the resignation of a member of the Court, the resignation shall be addressed to the President of the Court for transmission to the Secretary-General. This last notification makes the place vacant.

    一、法官任期九年,并得連選,但第一次選舉選出之法官中,五人任期應(yīng)為三年,另五人為六年。
    二、上述初期法官,任期孰為三年孰為六年,應(yīng)于第一次選舉完畢后立由秘書長(zhǎng)以抽簽方法決定之。
    三、法官在其后任接替前,應(yīng)繼續(xù)行使其職務(wù),雖經(jīng)接替,仍應(yīng)結(jié)束其已開始辦理之案件。
    四、法官辭職時(shí)應(yīng)將辭職書致送法院院長(zhǎng)轉(zhuǎn)知秘書長(zhǎng)。轉(zhuǎn)知后,該法官之一席即行出缺。
Article 14
Vacancies shall be filled by the same method as that laid down for the first election, subject to the following provision: the Secretary-General shall, within one month of the occurrence of the vacancy, proceed to issue the invitations provided for in Article 5, and the date of the election shall be fixed by the Security Council.
    第十四條  
    凡遇出缺,應(yīng)照第一次選舉時(shí)所定之辦法補(bǔ)選之,但秘書長(zhǎng)應(yīng)于法官出缺后一個(gè)月內(nèi),發(fā)出第五條規(guī)定之邀請(qǐng)書并由安全理事會(huì)指定選舉日期。
Article 15
A member of the Court elected to replace a member whose term of office has not expired shall hold office for the remainder of his predecessor's term.
    第十五條  
    法官被選以接替任期未滿之法官者,應(yīng)任職至其前任法官任期屆滿時(shí)為止。
Article 16
1. No member of the Court may exercise any political or administrative function, or engage in any other occupation of a professional nature.
2. Any doubt on this point shall be settled by the decision of the Court.
    第十六條  
    一、法官不得行使任何政治或行政職務(wù),或執(zhí)行任何其他職業(yè)性質(zhì)之任務(wù)。
    二、關(guān)于此點(diǎn),如有疑義,應(yīng)由法院裁決之。
Article 17
1. No member of the Court may act as agent, counsel, or advocate in any case.
2. No member may participate in the decision of any case in which he has previously taken part as agent, counsel, or advocate for one of the parties, or as a member of a national or international court, or of a commission of enquiry, or in any other capacity.
3. Any doubt on this point shall be settled by the decision of the Court.
    第十七條  
    一、法官對(duì)于任何案件,不得充任代理人、律師、或輔佐人。
    二、法官曾以當(dāng)事國(guó)一造之代理人、律師、或輔佐人、或以國(guó)內(nèi)法院或國(guó)際法院或調(diào)查委員會(huì)委員、或以其他資格參加任何案件者,不得參與該案件之裁決。
    三、關(guān)于此點(diǎn),如有疑義,應(yīng)由法院決定之。
Article 18
1. No member of the Court can be dismissed unless, in the unanimous opinion of the other members, he has ceased to fulfill the required conditions.
2. Formal notification thereof shall be made to the Secretary-General by the Registrar.
3. This notification makes the place vacant.
    第十八條  
    一、法官除由其余法官一致認(rèn)為不復(fù)適合必要條件外,不得免職。
    二、法官之免職,應(yīng)由書記官長(zhǎng)正式通知秘書長(zhǎng)。
    三、此項(xiàng)通知一經(jīng)送達(dá)秘書長(zhǎng),該法官之一席即行出缺。
Article 19
The members of the Court, when engaged on the business of the Court, shall enjoy diplomatic privileges and immunities.
    第十九條  
    法官于執(zhí)行法院職務(wù)時(shí),應(yīng)享受外交特權(quán)及豁免。
Article 20
Every member of the Court shall, before taking up his duties, make a solemn declaration in open court that he will exercise his powers impartially and conscientiously.
    第二十條  
    法官于就職前應(yīng)在公開法庭鄭重宣言本人必當(dāng)秉公竭誠(chéng)行使職權(quán)。
Article 21
1. The Court shall elect its President and Vice-President for three years; they may be re-elected.
2. The Court shall appoint its Registrar and may provide for the appointment of such other officers as may be necessary.
    第二十一條  
    一、法院應(yīng)選舉院長(zhǎng)及副院長(zhǎng),其任期各三年,并得連選。
    二、法院應(yīng)委派書記官長(zhǎng),并得酌派其他必要之職員。
Article 22
1. The seat of the Court shall be established at The Hague. This, however, shall not prevent the Court from sitting and exercising its functions elsewhere whenever the Court considers it desirable.
2. The President and the Registrar shall reside at the seat of the Court.
    第二十二條  
    一、法院設(shè)在海牙,但法院如認(rèn)為合宜時(shí),得在他處開庭及行使職務(wù)。
    二、院長(zhǎng)及書記官長(zhǎng)應(yīng)駐于法院所在地。
Article 23
1. The Court shall remain permanently in session, except during the judicial vacations, the dates and duration of which shall be fixed by the Court.
2. Members of the Court are entitled to periodic leave, the dates and duration of which shall be fixed by the Court, having in mind the distance between The Hague and the home of each judge.
3. Members of the Court shall be bound, unless they are on leave or prevented from attending by illness or other serious reasons duly explained to the President, to hold themselves permanently at the disposal of the Court.
    第二十三條  
    一、法院除司法假期外,應(yīng)常川辦公。司法假期之日期及期間由法院定之。
    二、法官得有定時(shí)假期,其日期及期間,由法院斟酌海牙與各法官住所之距離定之。
    三、法官除在假期或因疾病或其他重大原由,不克視事,經(jīng)向院長(zhǎng)作適當(dāng)之解釋外,應(yīng)常川備由法院分配工作。
Article 24
1. If, for some special reason, a member of the Court considers that he should not take part in the decision of a particular case, he shall so inform the President.
2. If the President considers that for some special reason one of the members of the Court should not sit in a particular case, he shall give him notice accordingly.
3. If in any such case the member Court and the President disagree, the matter shall be settled by the decision of the Court.
    第二十四條  
    一、法官如因特別原由認(rèn)為于某案之裁判不應(yīng)參與時(shí)。應(yīng)通知院長(zhǎng)。
    二、院長(zhǎng)如認(rèn)某法官因特別原由不應(yīng)參與某案時(shí),應(yīng)以此通知該法官。
    三、遇有此種情形,法官與院長(zhǎng)意見不同時(shí),應(yīng)由法院決定之。
Article 25
1. The full Court shall sit except when it is expressly provided otherwise in the present Statute.
2. Subject to the condition that the number of judges available to constitute the Court is not thereby reduced below eleven, the Rules of the Court may provide for allowing one or more judges, according to circumstances and in rotation, to be dispensed from sitting.
3. A quorum of nine judges shall suffice to constitute the Court.
    第二十五條  
    一、除本規(guī)約另有規(guī)定外,法院應(yīng)由全體法官開庭。
    二、法院規(guī)則得按情形并以輪流方法,規(guī)定準(zhǔn)許法官一人或數(shù)人免予出席,但準(zhǔn)備出席之法官人數(shù)不得因此減至少于11人。
    三、法官九人即足構(gòu)成法院之法定人數(shù)。
Article 26
1. The Court may from time to time form one or more chambers, composed of three or more judges as the Court may determine, for dealing with particular categories of cases; for example, labour cases and cases relating to transit and communications.
2. The Court may at any time form a chamber for dealing with a particular case. The number of judges to constitute such a chamber shall be determined by the Court with the approval of the parties.
3. Cases shall be heard and determined by the chambers provided for in this article if the parties so request.
    第二十六條  
    一、法院得隨時(shí)設(shè)立一個(gè)或數(shù)個(gè)分庭,并得決定由法官三人或三人以上組織之。此項(xiàng)分庭處理特種案件,例如勞工案件及關(guān)于過境與交通案件。
    二、法院為處理某特定案件,得隨時(shí)設(shè)立分庭,組織此項(xiàng)分庭法官之人數(shù),應(yīng)由法院得當(dāng)事國(guó)之同意定之。
    三、案件經(jīng)當(dāng)事國(guó)之請(qǐng)求應(yīng)由本條規(guī)定之分庭審理裁判之。
Article 27
A judgment given by any of the chambers provided for in Articles 26 and 29 shall be considered as rendered by the Court.
    第二十七條  
    第二十六條  及第二十九條規(guī)定之任何分庭所為之裁判,應(yīng)視為法院之裁判。
Article 28
The chambers provided for in Articles 26 and 29 may, with the consent of the parties, sit and exercise their functions elsewhere than at The Hague.
    第二十八條  
    第二十六條  及第二十九條規(guī)定之分庭,經(jīng)當(dāng)事國(guó)之同意,得在海牙以外地方開庭及行使職務(wù)。
Article 29
With a view to the speedy dispatch of business, the Court shall form annually a chamber composed of five judges which, at the request of the parties, may hear and determine cases by summary procedure. In addition, two judges shall be selected for the purpose of replacing judges who find it impossible to sit.
    第二十九條  
    法院為迅速處理事務(wù),應(yīng)于每年以法官五人組織一分庭。該分庭經(jīng)當(dāng)事國(guó)之請(qǐng)求,得用簡(jiǎn)易程序,審理及裁判案件。法院并應(yīng)選定法官二人,以備接替不能出庭之法官。
Article 30
1. The Court shall frame rules for carrying out its functions. In particular, it shall lay down rules of procedure.
2. The Rules of the Court may provide for assessors to sit with the Court or with any of its chambers, without the right to vote.
    第三十條  
    一、法院應(yīng)訂立規(guī)則,以執(zhí)行其職務(wù),尤應(yīng)訂定關(guān)于程序之規(guī)則。
    二、法院規(guī)則得規(guī)定關(guān)于襄審官之出席法院或任何分庭,但無(wú)表決權(quán)。
Article 31
1. Judges of the nationality of each of the parties shall retain their right to sit in the case before the Court.
2. If the Court includes upon the Bench a judge of the nationality of one of the parties, any other party may choose a person to sit as judge. Such person shall be chosen preferably from among those persons who have been nominated as candidates as provided in Articles 4 and 5.
3. If the Court includes upon the Bench no judge of the nationality of the parties, each of these parties may proceed to choose a judge as provided in paragraph 2 of this Article.
4. The provisions of this Article shall apply to the case of Articles 26 and 29. In such cases, the President shall request one or, if necessary, two of the members of the Court forming the chamber to give place to the members of the Court of the nationality of the parties concerned, and, failing such, or if they are unable to be present, to the judges specially chosen by the parties.
5. Should there be several parties in the same interest, they shall, for the purpose of the preceding provisions, be reckoned as one party only. Any doubt upon this point shall be settled by the decision of the Court.
6. Judges chosen as laid down in paragraphs 2, 3, and 4 of this Article shall fulfill the conditions required by Articles 2, 17 (paragraph 2), 20, and 24 of the present Statute. They shall take part in the decision on terms of complete equality with their colleagues.
    第三十一條  
    一、屬于訴訟當(dāng)事國(guó)國(guó)籍之法官,于法院受理該訴訟案件時(shí),保有其參與之權(quán)。
    二、法院受理案件,如法官中有屬于一造當(dāng)事國(guó)之國(guó)籍者,任何他造當(dāng)事國(guó)得選派一人為法官,參與該案。此項(xiàng)人員尤以就第四條及第五條規(guī)定所提之候選人中選充為宜。
    三、法院受理案件,如當(dāng)事國(guó)均無(wú)本國(guó)國(guó)籍法官時(shí),各當(dāng)事國(guó)均得依本條第二項(xiàng)之規(guī)定選派法官一人。
    四、本條之規(guī)定于第二十六條及第二十九條之情形適用之。在此種情形下,院長(zhǎng)應(yīng)請(qǐng)分庭法官一人,或于必要時(shí)二人,讓與屬于關(guān)系當(dāng)事國(guó)國(guó)籍之法官,如無(wú)各當(dāng)事國(guó)國(guó)籍之法官或各該法官不能出席時(shí),應(yīng)讓與各當(dāng)事國(guó)特別選派之法官。
    五、如數(shù)當(dāng)事國(guó)具有同樣利害關(guān)系時(shí),在上列各規(guī)定適用范圍內(nèi),只應(yīng)作為一當(dāng)事國(guó)。關(guān)于此點(diǎn),如有疑義,由法院裁決之。
    六、依本條第二項(xiàng)、第三項(xiàng)、及第四項(xiàng)規(guī)定所選派之法官,應(yīng)適合本規(guī)約第二條、第十七條第二項(xiàng)、第二十條、及第二十四條規(guī)定之條件。各該法官參與案件之裁判時(shí),與其同事立于完全平等地位。
Article 32
1. Each member of the Court shall receive an annual salary.
2. The President shall receive a special annual allowance.
3. The Vice-President shall receive a special allowance for every day on which he acts as President.
4. The judges chosen under Article 31, other than members of the Court, shall receive compensation for each day on which they exercise their functions.
5. These salaries, allowances, and compensation shall be fixed by the General Assembly. They may not be decreased during the term of office.
6. The salary of the Registrar shall be fixed by the General Assembly on the proposal of the Court.
7. Regulations made by the General Assembly shall fix the conditions under which retirement pensions may be given to members of the Court and to the Registrar, and the conditions under which members of the Court and the Registrar shall have their travelling expenses refunded.
8. The above salaries, allowances, and compensation shall be free of all taxation.

    七、法官及書記官長(zhǎng)支給退休金及補(bǔ)領(lǐng)旅費(fèi)之條件,由大會(huì)訂立章程規(guī)定之。
    八、上列俸給津貼及酬金,應(yīng)免除一切稅捐。
Article 33
The expenses of the Court shall be borne by the United Nations in such a manner as shall be decided by the General Assembly.

Chapter II: Competence of the Court
第二章  法院之管轄
Article 34
1. Only states may be parties in cases before the Court.
2. The Court, subject to and in conformity with its Rules, may request of public international organizations information relevant to cases before it, and shall receive such information presented by such organizations on their own initiative.
3. Whenever the construction of the constituent instrument of a public international organization or of an international convention adopted thereunder is in question in a case before the Court, the Registrar shall so notify the public international organization concerned and shall communicate to it copies of all the written proceedings.

Article 35
1. The Court shall be open to the states parties to the present Statute.
2. The conditions under which the Court shall be open to other states shall, subject to the special provisions contained in treaties in force, be laid down by the Security Council, but in no case shall such conditions place the parties in a position of inequality before the Court.
3. When a state which is not a Member of the United Nations is a party to a case, the Court shall fix the amount which that party is to contribute towards the expenses of the Court. This provision shall not apply if such state is bearing a share of the expenses of the Court.

    一、法院受理本規(guī)約各當(dāng)事國(guó)之訴訟。
    二、法院受理其他各國(guó)訴訟之條件,除現(xiàn)行條約另有特別規(guī)定外,由安全理事會(huì)定之,但無(wú)論如何,此項(xiàng)條件不得使當(dāng)事國(guó)在法院處于不平等地位。
    三、非聯(lián)合國(guó)會(huì)員國(guó)為案件之當(dāng)事國(guó)時(shí),其應(yīng)擔(dān)負(fù)法院費(fèi)用之?dāng)?shù)目由法院定之。如該國(guó)業(yè)已分擔(dān)法院經(jīng)費(fèi)之一部,本項(xiàng)規(guī)定不適用之。
Article 36
1. The jurisdiction of the Court comprises all cases which the parties refer to it and all matters specially provided for in the Charter of the United Nations or in treaties and conventions in force.
2. The states parties to the present Statute may at any time declare that they recognize as compulsory ipso facto and without special agreement, in relation to any other state accepting the same obligation, the jurisdiction of the Court in all legal disputes concerning:
a. the interpretation of a treaty;
b. any question of international law;
c. the existence of any fact which, if established, would constitute a breach of an international obligation;
d. the nature or extent of the reparation to be made for the breach of an international obligation.
3. The declarations referred to above may be made unconditionally or on condition of reciprocity on the part of several or certain states, or for a certain time.
4. Such declarations shall be deposited with the Secretary-General of the United Nations, who shall transmit copies thereof to the parties to the Statute and to the Registrar of the Court.
5. Declarations made under Article 36 of the Statute of the Permanent Court of International Justice and which are still in force shall be deemed, as between the parties to the present Statute, to be acceptances of the compulsory jurisdiction of the International Court of Justice for the period which they still have to run and in accordance with their terms.
6. In the event of a dispute as to whether the Court has jurisdiction, the matter shall be settled by the decision of the Court.

    一、法院之管轄包括各當(dāng)事國(guó)提交之一切案件,及聯(lián)合國(guó)憲章或現(xiàn)行條約及協(xié)約中所特定之一切事件。
    二、本規(guī)約各當(dāng)事國(guó)得隨時(shí)聲明關(guān)于具有下列性質(zhì)之一切法律爭(zhēng)端,對(duì)于接受同樣義務(wù)之任何其他國(guó)家,承認(rèn)法院之管轄為當(dāng)然而具有強(qiáng)制性,不須另訂特別協(xié)定:
    (子)條約之解釋。
    (丑)國(guó)際法之任何問題。
    (寅)任何事實(shí)之存在,如經(jīng)確定即屬違反國(guó)際義務(wù)者。
    (卯)因違反國(guó)際義務(wù)而應(yīng)予賠償之性質(zhì)及其范圍。
    三、上述聲明,得無(wú)條件為之,或以數(shù)個(gè)或特定之國(guó)家間彼此拘束為條件,或以一定之期間為條件。
    四、此項(xiàng)聲明應(yīng)交存聯(lián)合國(guó)秘書長(zhǎng)并由其將副本分送本規(guī)約各當(dāng)事國(guó)及法院書記官長(zhǎng)。
    五、曾依常設(shè)國(guó)際法院規(guī)約第三十六條所為之聲明而現(xiàn)仍有效者,就本規(guī)約當(dāng)事國(guó)間而言,在該項(xiàng)聲明期間尚未屆滿前并依其條款,應(yīng)認(rèn)為對(duì)于國(guó)際法院強(qiáng)制管轄之接受。
    六、關(guān)于法院有無(wú)管轄權(quán)之爭(zhēng)端,由法院裁決之。
Article 37
Whenever a treaty or convention in force provides for reference of a matter to a tribunal to have been instituted by the League of Nations, or to the Permanent Court of International Justice, the matter shall, as between the parties to the present Statute, be referred to the International Court of Justice.

    現(xiàn)行條約或協(xié)約或規(guī)定某項(xiàng)事件應(yīng)提交國(guó)際聯(lián)合會(huì)所設(shè)之任何裁判機(jī)關(guān)或常設(shè)國(guó)際法院者,在本規(guī)約當(dāng)事國(guó)間,該項(xiàng)事件應(yīng)提交國(guó)際法院。
Article 38
1. The Court, whose function is to decide in accordance with international law such disputes as are submitted to it, shall apply:
a. international conventions, whether general or particular, establishing rules expressly recognized by the contesting states;
b. international custom, as evidence of a general practice accepted as law;
c. the general principles of law recognized by civilized nations;
d. subject to the provisions of Article 59, judicial decisions and the teachings of the most highly qualified publicists of the various nations, as subsidiary means for the determination of rules of law.
2. This provision shall not prejudice the power of the Court to decide a case ex aequo et bono, if the parties agree thereto.

    一、法院對(duì)于陳訴各項(xiàng)爭(zhēng)端,應(yīng)依國(guó)際法裁判之,裁判時(shí)應(yīng)適用:
    (子)不論普通或特別國(guó)際協(xié)約,確立訴訟當(dāng)事國(guó)明白承認(rèn)之規(guī)條者。
    (丑)國(guó)際習(xí)慣,作為能例之證明而經(jīng)接受為法律者。
    (寅)一般法律原則為文明各國(guó)所承認(rèn)者。
    (卯)在第五十九條規(guī)定之下,司法判例及各國(guó)權(quán)威最高之公法學(xué)家學(xué)說(shuō),作為確定法律原則之補(bǔ)助資料者。
    二、前項(xiàng)規(guī)定不妨礙法院經(jīng)當(dāng)事國(guó)同意本“公允及善良”原則裁判案件之權(quán)。
Chapter III: Procedure
第三章  程序
Article 39
1. The official languages of the Court shall be French and English. If the parties agree that the case shall be conducted in French, the judgment shall be delivered in French. If the parties agree that the case shall be conducted in English, the judgment shall be delivered in English.
2. In the absence of an agreement as to which language shall be employed, each party may, in the pleadings, use the language which it prefers; the decision of the Court shall be given in French and English. In this case the Court shall at the same time determine which of the two texts shall be considered as authoritative.
3. The Court shall, at the request of any party, authorize a language other than French or English to be used by that party.

    一、法院正式文字為英法兩文。如各當(dāng)事國(guó)同意用法文辦理案件,其判決應(yīng)以法文為之。如各當(dāng)事國(guó)同意用英文辦理案件,其判決應(yīng)以英文為之。
    二、如未經(jīng)同意應(yīng)用何種文字,每一當(dāng)事國(guó)于陳述中得擇用英法兩文之一,而法院之判詞應(yīng)用英法兩文。法院并應(yīng)同時(shí)確定以何者為準(zhǔn)。
    三、法院經(jīng)任何當(dāng)事國(guó)之請(qǐng)求,應(yīng)準(zhǔn)該當(dāng)事國(guó)用英法文以外之文字。
Article 40
1. Cases are brought before the Court, as the case may be, either by the notification of the special agreement or by a written application addressed to the Registrar. In either case the subject of the dispute and the parties shall be indicated.
2. The Registrar shall forthwith communicate the application to all concerned.
3. He shall also notify the Members of the United Nations through the Secretary-General, and also any other states entitled to appear before the Court.

    一、向法院提出訴訟案件,應(yīng)按其情形將所訂特別協(xié)定通告書記官長(zhǎng)或以請(qǐng)求書送達(dá)書記官長(zhǎng)。不論用何項(xiàng)方法,均應(yīng)敘明爭(zhēng)端事由及各當(dāng)事國(guó)。
    二、書記官長(zhǎng)應(yīng)立將請(qǐng)求書通知有關(guān)各方。
    三、書記官長(zhǎng)并應(yīng)經(jīng)由秘書長(zhǎng)通知聯(lián)合國(guó)會(huì)員國(guó)及有權(quán)在法院出庭其他之國(guó)家。
Article 41
1. The Court shall have the power to indicate, if it considers that circumstances so require, any provisional measures which ought to be taken to preserve the respective rights of either party.
2. Pending the final decision, notice of the measures suggested shall forthwith be given to the parties and to the Security Council.
    第四十一條  
    一、法院如認(rèn)情形有必要時(shí),有權(quán)指示當(dāng)事國(guó)應(yīng)行遵守以保全彼此權(quán)利之臨時(shí)辦法。
    二、在終局判決前,應(yīng)將此項(xiàng)指示辦法立即通知各當(dāng)事國(guó)及安全理事會(huì)。
Article 42
1. The parties shall be represented by agents.
2. They may have the assistance of counsel or advocates before the Court.
3. The agents, counsel, and advocates of parties before the Court shall enjoy the privileges ,and immunities necessary to the independent exercise of their duties.
    第四十二條  
    一、各當(dāng)事國(guó)應(yīng)由代理人代表之。
    二、各當(dāng)事國(guó)得派律師或輔佐人在法院予以協(xié)助。
    三、各當(dāng)事國(guó)之代理人、律師、及輔佐人應(yīng)享受關(guān)于獨(dú)立行使其職務(wù)所必要之特權(quán)及豁免。
Article 43
1. The procedure shall consist of two parts: written and oral.
2. The written proceedings shall consist of the communication to the Court and to the parties of memorials, counter-memorials and, if necessary, replies; also all papers and documents in support.
3. These communications shall be made through the Registrar, in the order and within the time fixed by the Court.
4. A certified copy of every document produced by one party shall be communicated to the other party.
5. The oral proceedings shall consist of the hearing by the Court of witnesses, experts, agents, counsel, and advocates.
    第四十三條  
    一、訴訟程序應(yīng)分書面與口述兩部分。
    二、書面程序系指以訴狀、辯訴狀、及必要時(shí)之答辯狀連同可資佐證之各種文件及公文書,送達(dá)法院及各當(dāng)事國(guó)。
    三、此項(xiàng)送達(dá)應(yīng)由書記官長(zhǎng)依法院所定次序及期限為之。
    四、當(dāng)事國(guó)一造所提出之一切文件應(yīng)將證明無(wú)訛之抄本一份送達(dá)他造。
    五、口述程序系指法院審訊證人、鑒定人、代理人、律師及輔佐人。
Article 44
1. For the service of all notices upon persons other than the agents, counsel, and advocates, the Court shall apply direct to the government of the state upon whose territory the notice has to be served.
2. The same provision shall apply whenever steps are to be taken to procure evidence on the spot.
    第四十四條  
    一、法院遇有對(duì)于代理人、律師、及輔佐人以外之人送達(dá)通知書,而須在某國(guó)領(lǐng)土內(nèi)行之者,應(yīng)徑向該國(guó)政府接洽。
    二、為就地搜集證據(jù)而須采取步驟時(shí),適用前項(xiàng)規(guī)定。
Article 45
The hearing shall be under the control of the President or, if he is unable to preside, of the Vice-President; if neither is able to preside, the senior judge present shall preside.
    第四十五條  
    法院之審訊應(yīng)由院長(zhǎng)指揮,院長(zhǎng)不克出席時(shí),由副院長(zhǎng)指揮;院長(zhǎng)副院長(zhǎng)均不克出席時(shí),由出席法官中之資深者主持。
Article 46
The hearing in Court shall be public, unless the Court shall decide otherwise, or unless the parties demand that the public be not admitted .
    第四十六條  
    法院之審訊應(yīng)公開行之,但法院另有決定或各當(dāng)事國(guó)要求拒絕公眾旁聽時(shí),不在此限。
Article 47
1. Minutes shall be made at each hearing and signed by the Registrar and the President.
2. These minutes alone shall be authentic.
    第四十七條  
    一、每次審訊應(yīng)作成記錄,由書記官長(zhǎng)及院長(zhǎng)簽名。
    二、前項(xiàng)記錄為唯一可據(jù)之記錄。
Article 48
The Court shall make orders for the conduct of the case, shall decide the form and time in which each party must conclude its arguments, and make all arrangements connected with the taking of evidence.
    第四十八條  
    法院為進(jìn)行辦理案件應(yīng)頒發(fā)命令;對(duì)于當(dāng)事國(guó)每造,應(yīng)決定其必須終結(jié)辯論之方式及時(shí)間;對(duì)于證據(jù)之搜集,應(yīng)為一切之措施。
Article 49
The Court may, even before the hearing begins, call upon the agents to produce any document or to supply any explanations. Formal note shall be taken of any refusal.
    第四十九條  
    法院在開始審訊前,亦得令代理人提出任何文件,或提供任何解釋。如經(jīng)拒絕應(yīng)予正式記載。
Article 50
The Court may, at any time, entrust any individual, body, bureau, commission, or other organization that it may select, with the task of carrying out an enquiry or giving an expert opinion.
    第五十條  
    法院得隨時(shí)選擇任何個(gè)人、團(tuán)體、局所、委員會(huì)、或其他組織,委以調(diào)查或鑒定之責(zé)。
Article 51
During the hearing any relevant questions are to be put to the witnesses and experts under the conditions laid down by the Court in the rules of procedure referred to in Article 30.
    第五十一條  
    審訊時(shí)得依第三十條所指法院在其程序規(guī)則中所定之條件,向證人及鑒定人提出任何切要有關(guān)之詰問。
Article 52
After the Court has received the proofs and evidence within the time specified for the purpose, it may refuse to accept any further oral or written evidence that one party may desire to present unless the other side consents.
    第五十二條  
    法院于所定期限內(nèi)收到各項(xiàng)證明及證據(jù)后,得拒絕接受當(dāng)事國(guó)一造欲提出之其他口頭或書面證據(jù),但經(jīng)他造同意者,不在此限。
Article 53
1. Whenever one of the parties does not appear before the Court, or fails to defend its case, the other party may call upon the Court to decide in favour of its claim.
2. The Court must, before doing so, satisfy itself, not only that it has jurisdiction in accordance with Articles 36 and 37, but also that the claim is well founded in fact and law.

    一、當(dāng)事國(guó)一造不到法院或不辯護(hù)其主張時(shí),他造得請(qǐng)求法院對(duì)自己主張為有利之裁判。
    二、法院于允準(zhǔn)前項(xiàng)請(qǐng)求前,應(yīng)查明不特依第三十六條及第三十七條法院對(duì)本案有管轄權(quán),且請(qǐng)求人之主張?jiān)谑聦?shí)及法律上均有根據(jù)。
Article 54
1. When, subject to the control of the Court, the agents, counsel, and advocates have completed their presentation of the case, the President shall declare the hearing closed.
2. The Court shall withdraw to consider the judgment.
3. The deliberations of the Court shall take place in private and remain secret.

    一、代理人律師及輔佐人在法院指揮下陳述其主張已完畢時(shí),院長(zhǎng)應(yīng)宣告辯論終結(jié)。
    二、法官應(yīng)退席討論判決。
    三、法官之評(píng)議應(yīng)秘密為之,并永守秘密。
Article 55
1. All questions shall be decided by a majority of the judges present.
2. In the event of an equality of votes, the President or the judge who acts in his place shall have a casting vote.
    第五十五條  
    一、一切問題應(yīng)由出席法官之過半數(shù)決定之。
    二、如投票數(shù)相等時(shí),院長(zhǎng)或代理院長(zhǎng)職務(wù)之法官應(yīng)投決定票。
Article 56
1. The judgment shall state the reasons on which it is based.
2. It shall contain the names of the judges who have taken part in the decision.
    第五十六條  
    一、判詞應(yīng)敘明理由。
    二、判詞應(yīng)載明參與裁判之法官姓名。
Article 57
If the judgment does not represent in whole or in part the unanimous opinion of the judges, any judge shall be entitled to deliver a separate opinion.
    第五十七條  
    判詞如全部或一部份不能代表法官一致之意見時(shí),任何法官得另行宣告其個(gè)別意見。
Article 58
The judgment shall be signed by the President and by the Registrar. It shall be read in open court, due notice having been given to the agents.
    第五十八條  
    判詞應(yīng)由院長(zhǎng)及書記官長(zhǎng)簽名,在法庭內(nèi)公開宣讀,并應(yīng)先期通知各代理人.
Article 59
The decision of the Court has no binding force except between the parties and in respect of that particular case.
    第五十九條  法院之裁判除對(duì)于當(dāng)事國(guó)及本案外,無(wú)拘束力。
Article 60
The judgment is final and without appeal. In the event of dispute as to the meaning or scope of the judgment, the Court shall construe it upon the request of any party.
    第六十條  
    法院之判決系屬確定,不得上訴。判詞之意義或范圍發(fā)生爭(zhēng)端時(shí),經(jīng)任何當(dāng)事國(guó)之請(qǐng)求后,法院應(yīng)予解釋。
Article 61
1. An application for revision of a judgment may be made only when it is based upon the discovery of some fact of such a nature as to be a decisive factor, which fact was, when the judgment was given, unknown to the Court and also to the party claiming revision, always provided that such ignorance was not due to negligence.
2. The proceedings for revision shall be opened by a judgment of the Court expressly recording the existence of the new fact, recognizing that it has such a character as to lay the case open to revision, and declaring the application admissible on this ground.
3. The Court may require previous compliance with the terms of the judgment before it admits proceedings in revision.
4. The application for revision must be made at latest within six months of the discovery of the new fact.
5. No application for revision may be made after the lapse of ten years from the date of the judgment.
    第六十一條  
    一、聲請(qǐng)法院覆核判決,應(yīng)根據(jù)發(fā)現(xiàn)具有決定性之事實(shí),而此項(xiàng)事實(shí)在判決宣告時(shí)為法院及聲請(qǐng)覆核之當(dāng)事國(guó)所不知者,但以非因過失而不知者為限。
    二、覆核程序之開始應(yīng)由法院下以裁決,載明新事實(shí)之存在,承認(rèn)此項(xiàng)新事實(shí)具有使本案應(yīng)予覆核之性質(zhì),并宣告覆核之聲請(qǐng)因此可予接受。
    三、法院于接受覆核訴訟前得令先行履行判決之內(nèi)容。
    四、聲請(qǐng)覆核至遲應(yīng)于新事實(shí)發(fā)現(xiàn)后六個(gè)月內(nèi)為之。
    五、聲請(qǐng)覆核自判決日起逾10年后不得為之。
Article 62
l. Should a state consider that it has an interest of a legal nature which may be affected by the decision in the case, it may submit a request to the Court to be permitted to intervene.
2 It shall be for the Court to decide upon this request.
    第六十二條  
    一、某一國(guó)家如認(rèn)為某案件之判決可影響屬于該國(guó)具有法律性質(zhì)之利益時(shí),得向法院聲請(qǐng)參加。
    二、此項(xiàng)聲請(qǐng)應(yīng)由法院裁決之。
Article 63
1. Whenever the construction of a convention to which states other than those concerned in the case are parties is in question, the Registrar shall notify all such states forthwith.
2. Every state so notified has the right to intervene in the proceedings; but if it uses this right, the construction given by the judgment will be equally binding upon it.

    一、凡協(xié)約發(fā)生解釋問題,而訴訟當(dāng)事國(guó)以外尚有其他國(guó)家為該協(xié)約之簽字國(guó)者,應(yīng)立由書記官長(zhǎng)通知各該國(guó)家。
    二、受前項(xiàng)通知之國(guó)家有參加程序之權(quán);但如該國(guó)行使此項(xiàng)權(quán)利時(shí),判決中之解釋對(duì)該國(guó)具有同樣拘束力。
Article 64
Unless otherwise decided by the Court, each party shall bear its own costs.
    第六十四條  
    除法院另有裁定外,訴訟費(fèi)用由各造當(dāng)事國(guó)自行擔(dān)負(fù)。
Chapter IV: Advisory Opinions
第四章  咨詢意見
Article 65
1. The Court may give an advisory opinion on any legal question at the request of whatever body may be authorized by or in accordance with the Charter of the United Nations to make such a request.
2. Questions upon which the advisory opinion of the Court is asked shall be laid before the Court by means of a written request containing an exact statement of the question upon which an opinion is required, and accompanied by all documents likely to throw light upon the question.

    一、法院對(duì)于任何法律問題如經(jīng)任何團(tuán)體由聯(lián)合國(guó)憲章授權(quán)而請(qǐng)求或依照聯(lián)合國(guó)憲章而請(qǐng)求時(shí),得發(fā)表咨詢意見。
    二、凡向法院請(qǐng)求咨詢意見之問題,應(yīng)以聲請(qǐng)書送交法院。此項(xiàng)聲請(qǐng)書對(duì)于咨詢意見之問題,應(yīng)有確切之?dāng)⑹,并?yīng)附送足以釋明該問題之一切文件。
Article 66
1. The Registrar shall forthwith give notice of the request for an advisory opinion to all states entitled to appear before the Court.
2. The Registrar shall also, by means of a special and direct communication, notify any state entitled to appear before the Court or international organization considered by the Court, or, should it not be sitting, by the President, as likely to be able to furnish information on the question, that the Court will be prepared to receive, within a time-limit to be fixed by the President, written statements, or to hear, at a public sitting to be held for the purpose, oral statements relating to the question.
3. Should any such state entitled to appear before the Court have failed to receive the special communication referred to in paragraph 2 of this Article, such state may express a desire to submit a written statement or to be heard; and the Court will decide.
4. States and organizations having presented written or oral statements or both shall be permitted to comment on the statements made by other states or organizations in the form, to the extent, and within the time-limits which the Court, or, should it not be sitting, the President, shall decide in each particular case. Accordingly, the Registrar shall in due time communicate any such written statements to states and organizations having submitted similar statements.

    二、書記官長(zhǎng)并應(yīng)以特別且直接之方法通知法院(或在法院不開庭時(shí),院長(zhǎng))所認(rèn)為對(duì)于咨詢問題能供給情報(bào)之有權(quán)在法院出庭之任何國(guó)家、或能供給情報(bào)之國(guó)際團(tuán)體,聲明法院于院長(zhǎng)所定之期限內(nèi)準(zhǔn)備接受關(guān)于該問題之書面陳述,或準(zhǔn)備于本案公開審訊時(shí)聽取口頭陳述。
    三、有權(quán)在法院出庭之任何國(guó)家如未接到本條第二項(xiàng)所指之特別通知時(shí),該國(guó)家得表示愿以書面或口頭陳述之意思,而由法院裁決之。
    四、凡已經(jīng)提出書面或口頭陳述或兩項(xiàng)陳述之國(guó)家及團(tuán)體,對(duì)于其他國(guó)家或團(tuán)體所提之陳述,準(zhǔn)其依法院(或在法院不開庭時(shí),院長(zhǎng))所定關(guān)于每案之方式,范圍及期限,予以評(píng)論。書記官長(zhǎng)應(yīng)于適當(dāng)時(shí)間內(nèi)將此項(xiàng)書面陳述通知已經(jīng)提出此類陳述之國(guó)家及團(tuán)體。
Article 67
The Court shall deliver its advisory opinions in open court, notice having been given to the Secretary-General and to the representatives of Members of the United Nations, of other states and of international organizations immediately concerned.

    法院應(yīng)將其咨詢意見當(dāng)庭公開宣告并先期通知秘書長(zhǎng)、聯(lián)合國(guó)會(huì)員國(guó)、及有直接關(guān)系之其他國(guó)家及國(guó)際團(tuán)體之代表。
Article 68
In the exercise of its advisory functions the Court shall further be guided by the provisions of the present Statute which apply in contentious cases to the extent to which it recognizes them to be applicable.
    第六十八條  
    法院執(zhí)行關(guān)于咨詢意見之職務(wù)時(shí),并應(yīng)參照本規(guī)約關(guān)于訴訟案件各條款之規(guī)定,但以法院認(rèn)為該項(xiàng)條款可以適用之范圍為限。
Chapter V: Amendment
第五章  修正
Article 69
Amendments to the present Statute shall be effected by the same procedure as is provided by the Charter of the United Nations for amendments to that Charter, subject however to any provisions which the General Assembly upon recommendation of the Security Council may adopt concerning the participation of states which are parties to the present Statute but are not Members of the United Nations.

    本規(guī)約之修正準(zhǔn)用聯(lián)合國(guó)憲章所規(guī)定關(guān)于修正憲章之程序,但大會(huì)經(jīng)安全理事會(huì)之建議得制定關(guān)于本規(guī)約當(dāng)事國(guó)而非聯(lián)合國(guó)會(huì)員國(guó)參加該項(xiàng)程序之任何規(guī)定。
Article 70
The Court shall have power to propose such amendments to the present Statute as it may deem necessary, through written communications to the Secretary-General, for consideration in conformity with the provisions of Article 69.
    第七十條
    法院認(rèn)為必要時(shí)得以書面向秘書長(zhǎng)提出對(duì)于本規(guī)約之修正案,由聯(lián)合國(guó)依照第六十九條之規(guī)定,加以討論。
